Section 6A was introduced as part of the Assam Accord of 1985, a political settlement to address illegal migration into Assam, from Bangladesh.

CJI Chandrachud, leading the majority opinion, stated that Section 6A balances humanitarian and economic concerns, applying to migrants arriving between 1950 and 1971.

Justice J.B. Pardiwala dissented, declaring Section 6A unconstitutional over time.
